Patents

Request to record different designated patent applications for the same invention

Content

  • If I have filed separate patent applications in two designated patent offices seeking protection for the same invention, can I file requests to record both designated patent applications?

You can file requests to record both designated patent applications. But under section 91(1)(f) of the Patents Ordinance the court can revoke a patent if it is one of two standard patents for the same invention and the applications were filed by the same person and have the same deemed date of filing.
