Hong Kong-invested enterprises in Guangdong are allowed to apply
for Guangdong Provincial Famous Trademarks
The Provisions for Identification and Administration of Guangdong Provincial Famous
Trademarks (the “Provisions”) were promulgated by Decree No.124 of the People’s
Government of Guangdong Province on 26 November 2008, and effective as of 1 January
2009. All Hong Kong-invested enterprises in Guangdong which are bodies corporate
established in the administrative areas of Guangdong Province satisfy the requirements
for “legal persons” stated in Article 6 of the Provisions. Therefore, Hong Kong-invested
enterprises engaging in domestic sales of goods or provision of services in the
Mainland and fulfilling the requirements stipulated in Article 6 of the Provisions
can apply for Guangdong Provincial Famous Trademarks in accordance with the Provisions.
Apart from the geographical and cultural proximity to Hong Kong, Guangdong Province
is in the front rank at national level for its economic and technological developments.
With the familiarity of Hong Kong brands among the business sector and the general
public, Guangdong serves as a gateway for access to the Mainland market. Hong Kong
enterprises can make use of the Guangdong network to extend their brands and products
to the rest of the Mainland. Benefits from obtaining identification of Guangdong
Provincial Famous Trademarks include not only more effective trademark protection,
but also enhancement of popularity and credibility of enterprises and their brands
in the Mainland to establish corporate image and goodwill.
