28 November 2014 The chapter on “Names, signatures and images of individuals; fictitious character, titles of books, films and songs” has been revised to provide further details in the section on “examination of trade marks consisting of surnames” and to update the examples as provided in the sections of “personal names and forenames” and “famous person actually trading”.
17 October 2014 The chapter on “Deficiencies checking” has been revised: the wording “Box 6 of Form T2;” in the penultimate paragraph on page 4 has been deleted.
22 August 2014 The chapter on “Deficiencies checking” has been revised to provide further details in the section on “Name of applicant”.
The chapter on “Language” has been revised to include the phrase “, but the name of an applicant may be provided in both Chinese and English in certain circumstances” in the first sentence of the third paragraph.
The chapter on “Appeals against decisions of the Registrar” has been revised to clarify the mode of commencement of appeal proceedings against decisions of the Registrar. A new section on “Parties to an appeal” has also been added to provide guidance on the identity of the respondent in the appeal proceedings.
11 July 2014 The chapter on “Opposition to registration” has been revised to provide more guidance on the filing of joint oppositions by multiple opponents.

The chapter on “Computation of time for filing at the Registry” has been revised:

  • The various “prescribed periods” for filing documents in opposition proceedings have been summarized and set out in the fifth paragraph.
  • Further examples have been added to illustrate the computation of deadline for filing a notice of opposition or a request for extension of time for filing a notice of opposition.
The chapter on “Merger of applications and registrations” has been amended: in the last point of the second page, section 51(1)(b) is amended to rule 53(2)(b).

The chapter on “Opposition to registration” has been revised:

  • The third paragraph has been deleted and cross reference has been made to the Chapter on “Computation of time for filing at the Registry” in the second paragraph.

The chapter on “Procedure where leave is sought to file further evidence” has been revised:

  • in the second paragraph of the first page, “rule 83” has been amended to “rule 82”; and
  • in the seventh bullet point of the second page, the word “the” has been added in between “be” and “last”.
The chapter on “Taxation of costs” has been revised (see the first paragraph of the fourth page and the seventh bullet point under the section on “General rules of taxation”) to clarify the Registry’s practice in relation to taxation of costs.

  • the section on “Sound marks” has been revised to provide further details; and
  • new sections on “Movement marks” and “Holograms” have been added to present the Registry’s examination practice.
