The chapter on “Appeals against decisions of the Registrar ” has been revised to –
(a) reflect the following legislative changes which come into effect on 1 October 2025:

  1. the substituted Order 100 of the Rules of the High Court (Cap. 4A) introduced under the Rules of the High Court (Amendment) (No. 2) Rules 2025; and
  2. amendments to the Trade Marks Rules introduced under the Trade Marks (Amendment) Rules 2025 (“TMR Amendments”);

(b) update references to case authorities on the Court’s approach in handling appeals against decisions of the Registrar;
(c) update the Registry’s practice in line with the Judiciary’s revised Practice Direction 22.1; and
(d) make various miscellaneous textual amendments.

The chapter on “Where the application is to be made” has been revised to –
(a) provide details of the procedure set out in the TMR Amendments where the Registrar decides to refer an application to the Court under section 77(1)(b) of the Trade Marks Ordinance; and
(b) make various miscellaneous textual amendments.

The chapters on “Applications for extension of time (other than under rules 13(3) and 13(6))” and “Orders of court transferring registered trade marks and applications” have been revised to –
(a) reflect the TMR Amendments; and
(b) make various miscellaneous textual amendments.

23 May 2025

The chapters on "Agents", "Address for service and change of name, address or address for service" and "Deficiencies checking" have been revised to –

(a) update the Registry’s new requirement of a declaration for an agent’s confirmation of its local physical presence in compliance with relevant statutory requirements, and reflect the Registry’s latest practice relating to unacceptable addresses and requirement of relevant proof;
(b) make consequential amendments resulting from the above revisions; and
(c) make various miscellaneous textual amendments.

The chapter on "Search" has been revised to provide further details relating to emblems, etc. protected under Article 6ter of the Paris Convention.

2 January 2025

The chapter on “Absolute grounds for refusal” has been revised to –

(a) elaborate the Registry’s examination practice in the sections on “Section 11(4)(a) – marks contrary to accepted principles of morality”, “Section 11(4)(b) – marks that are likely to deceive”, and “Section 11(5)(a) – use prohibited in Hong Kong by virtue of any law”; and
(b) make various miscellaneous textual amendments.
